Important Safety Notice: DriftMeter is designed for use at controlled motorsport facilities, private property with owner permission, or closed courses. Never use DriftMeter on public roads or in any situation that would endanger yourself or others. Always prioritize safety and comply with all applicable laws.
Welcome to DriftMeter. By downloading, installing, or using the DriftMeter application or related services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.
1. Acceptance of Terms
By accessing or using DriftMeter, you represent that:
- You are at least 18 years old (or the age of majority in your jurisdiction)
- You have the legal capacity to enter into a binding agreement
- You will use the Services in compliance with these Terms and all applicable laws
- If using the Services on behalf of an organization, you have authority to bind that organization to these Terms
2. Description of Services
DriftMeter is a drift telemetry application that:
- Captures sensor data from your device (GPS, accelerometer, gyroscope) during driving sessions
- Calculates drift metrics including angle, speed, duration, and composite scores
- Provides session history, statistics, and performance tracking
- Offers leaderboards to compare performance with other users
- Enables sharing of session data via unique links
The Services are provided for informational and entertainment purposes only. Drift metrics are calculated using consumer-grade device sensors and mathematical algorithms; they should not be relied upon for professional timing, safety decisions, or competitive scoring.
3. Account and Anonymous Identity
3.1 Anonymous Identification
DriftMeter uses an anonymous identification system:
- The App generates a random cryptographic identifier on your device
- No email, name, or personal information is required to use the basic features
- Your anonymous ID associates your sessions and statistics with your device
- You may optionally set a nickname for leaderboard display
3.2 Account Security
You are responsible for maintaining the security of your device and the anonymous credentials stored on it. We are not liable for any loss or damage arising from unauthorized access to your device or account.
3.3 Account Deletion
You may delete your account and all associated data at any time through the App settings. Deletion is permanent and cannot be undone. See our Privacy Policy for details on data retention.
4. Subscription and Payments
4.1 Free and Pro Tiers
DriftMeter offers:
- Free tier: Limited to 3 sessions per day with access to core drift tracking features
- Pro subscription: Unlimited sessions, priority features, and enhanced functionality
4.2 Payment Processing
All payments are processed through Apple App Store or Google Play Store. By subscribing to DriftMeter Pro:
- You agree to the payment terms of the respective app store
- Subscriptions automatically renew unless cancelled before the renewal date
- You can manage or cancel subscriptions through your device's app store settings
- We do not have access to your payment card details
4.3 Refunds
Refund requests must be made through Apple App Store or Google Play Store according to their respective refund policies. We cannot process refunds directly.
4.4 Price Changes
We reserve the right to modify subscription prices. Price changes will not affect current subscription periods and will apply to renewals after notice is provided through the app stores.
5. Acceptable Use
5.1 Permitted Use
You may use DriftMeter to:
- Record and analyze your drift driving sessions at appropriate venues
- Track your performance statistics and personal bests
- Compare your rankings on public leaderboards
- Share your sessions via generated links
5.2 Prohibited Conduct
You agree NOT to:
- Endanger safety: Use the App while operating a vehicle in an unsafe manner or on public roads where such use is prohibited
- Violate laws: Use the Services in any way that violates local, state, national, or international laws or regulations
- Falsify data: Submit fraudulent, manipulated, or artificially generated session data
- Circumvent systems: Attempt to bypass the anti-cheat system, session limits, or subscription verification
- Reverse engineer: Decompile, disassemble, reverse engineer, or attempt to extract the source code of the App or our servers
- Interfere with service: Disrupt, overload, or impair the functioning of our servers or networks
- Automated access: Use bots, scripts, or automated tools to access the Services without authorization
- Resell or redistribute: Sell, license, or commercially exploit the Services without our written permission
- Offensive nicknames: Use nicknames that are offensive, discriminatory, impersonate others, or violate any laws
- Exploit vulnerabilities: Exploit bugs, errors, or security vulnerabilities for advantage
5.3 Anti-Cheat and Data Integrity
DriftMeter employs physics-based validation to detect implausible data. We reserve the right to:
- Flag, investigate, or reject sessions that fail plausibility checks
- Remove users from leaderboards for suspected cheating
- Suspend or terminate accounts that submit fraudulent data
- Modify our detection algorithms without notice
6. User Content and Leaderboards
6.1 Your Content
By uploading session data, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and process that data for providing the Services, including aggregated analytics and leaderboard features.
6.2 Leaderboard Rules
Participation in leaderboards is subject to these rules:
- Rankings are based on verified session data
- Leaderboards reset periodically (rounds) as announced in the App
- We may adjust rankings or remove entries that violate these Terms
- Leaderboard placement does not constitute an endorsement of driving style or venue
6.3 Shared Content
When you share a session via a unique link, you acknowledge that:
- Anyone with the link can view the session data
- Shared sessions may include location data and your nickname
- You are responsible for who you share links with
7. Safety and Disclaimer
CRITICAL SAFETY DISCLAIMER:
Drifting and high-performance driving are inherently dangerous activities that can result in serious injury, death, or property damage. DriftMeter is NOT a safety device and does NOT replace proper training, safety equipment, or professional instruction.
7.1 Your Responsibility
You acknowledge and agree that:
- You assume all risks associated with driving and drifting activities
- You will use DriftMeter only at appropriate venues (race tracks, private property with permission, or closed courses)
- You will comply with all traffic laws and venue regulations
- You will never operate a vehicle unsafely while using the App
- A passenger should operate the device if possible to minimize distraction
- You are solely responsible for your driving decisions and their consequences
7.2 No Professional Advice
DriftMeter does not provide driving instruction, safety advice, or professional training. The metrics displayed are for informational purposes only and may not be accurate for competitive or professional use.
7.3 Venue Compliance
You are responsible for ensuring you have permission to record sessions at any venue and that your activities comply with the venue's rules and insurance requirements.
8. Intellectual Property
8.1 Our Rights
DriftMeter and all associated content, features, and functionality (including but not limited to design, code, algorithms, trademarks, and documentation) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.
8.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
8.3 Restrictions
You may not:
- Copy, modify, or create derivative works based on the App
- Remove any copyright, trademark, or proprietary notices
- Use our trademarks or branding without written permission
- Claim ownership of our intellectual property
9. Measurement Accuracy Disclaimer
NO GUARANTEE OF ACCURACY: DriftMeter does not guarantee the accuracy, precision, or reliability of any measurements, calculations, or metrics displayed in the App. All data is provided for informational and entertainment purposes only.
9.1 Algorithmic Calculations
DriftMeter employs advanced mathematical and physics-based algorithms to estimate drift metrics, including:
- Kalman filtering: Statistical estimation techniques to reduce sensor noise and predict vehicle state
- Sensor fusion: Combining data from multiple sensors (GPS, accelerometer, gyroscope) to improve estimates
- GPS-IMU time alignment: Cross-correlation algorithms to synchronize location and motion data streams
- Yaw rate integration: Mathematical integration of gyroscope readings to estimate drift angle
- Speed derivation: Calculations based on GPS position changes and Doppler measurements
These algorithms are based on sound mathematical principles and physics models; however, they are approximations that operate on imperfect real-world data. No algorithm can guarantee 100% accuracy.
9.2 Consumer Device Sensor Limitations
DriftMeter relies on sensors built into consumer smartphones, which have inherent limitations:
- GPS accuracy: Consumer GPS typically has accuracy of 3-10 meters, with potential for larger errors in certain conditions
- Sensor calibration: Device sensors may be improperly calibrated or degrade over time
- Sampling rates: Consumer devices may not maintain consistent sensor sampling rates under all conditions
- Hardware variations: Different device models and manufacturers have varying sensor quality and characteristics
- Sensor drift: Gyroscopes and accelerometers can experience cumulative drift errors over time
- Processing delays: Device processing load can introduce timing inconsistencies in sensor readings
9.3 External Factors Affecting Measurements
Numerous external factors beyond our control can significantly impact measurement accuracy:
- GPS signal quality: Buildings, trees, terrain, tunnels, and atmospheric conditions can degrade GPS accuracy
- Electromagnetic interference: Electronic equipment, power lines, and other devices can affect sensor readings
- Device mounting: Phone position, orientation, and stability in the vehicle affect sensor data quality
- Vehicle dynamics: Suspension movement, vibrations, and body roll can introduce noise into measurements
- Temperature: Extreme temperatures can affect sensor performance and battery-related processing throttling
- Surface conditions: Road surface, grip levels, and inclines are not accounted for in calculations
- Multi-path GPS errors: Signal reflections from nearby surfaces can cause position jumps
9.4 Not Suitable for Professional Use
DriftMeter metrics are NOT suitable for:
- Professional motorsport timing or official competition scoring
- Vehicle safety assessments or engineering analysis
- Insurance, legal, or liability determinations
- Any application requiring certified or calibrated measurements
- Comparison with professional telemetry systems
For professional applications, use dedicated motorsport telemetry equipment with certified accuracy specifications.
10. General Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We specifically disclaim:
- Accuracy: As detailed in Section 9, all measurements are estimates subject to significant potential errors
- Availability: The Services may be interrupted, delayed, or contain errors
- Fitness: No warranty that the Services are suitable for any particular purpose
- Security: No guarantee against unauthorized access or data breaches
- Third parties: No responsibility for third-party services, links, or content
- Consistency: Results may vary between sessions, devices, and conditions even under similar circumstances
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- We shall not be liable for any loss of data, revenue, profits, or business opportunities
- We shall not be liable for any personal injury, death, or property damage arising from your use of the Services or driving activities
- Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $50 USD, whichever is greater
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless DriftMeter, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third-party rights
- Your driving activities or any incidents related thereto
- Content you submit or share through the Services
13. Termination
13.1 By You
You may stop using the Services and delete your account at any time.
13.2 By Us
We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice, including for:
- Violation of these Terms
- Suspected fraudulent or illegal activity
- Conduct harmful to other users or the Services
- Extended periods of inactivity
- Requests by law enforcement or government agencies
13.3 Effect of Termination
Upon termination:
- Your right to use the Services immediately ceases
- We may delete your data (or retain it as required by law)
- Provisions that should survive termination will remain in effect (including Disclaimers, Limitation of Liability, and Indemnification)
14. Changes to Terms
We may modify these Terms at any time. We will notify users of material changes by:
- Updating the "Last updated" date at the top
- Providing notice through the App or via email (if provided)
Your continued use of the Services after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Services.
15. Governing Law and Disputes
15.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles.
15.2 Dispute Resolution
Any disputes arising from these Terms or the Services shall be resolved through:
- Informal negotiation: We encourage you to contact us first to resolve any issues
- Binding arbitration: If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except where prohibited by law
- Class action waiver: You agree to resolve disputes individually and waive any right to participate in class actions
15.3 Exceptions
Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property infringement or other urgent matters.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and DriftMeter regarding the Services.
16.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
16.4 Assignment
You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction.
16.5 No Partnership
Nothing in these Terms creates a partnership, joint venture, or agency relationship between you and DriftMeter.
